We guarantee that we will perform the physical rituals of Hajj Badal (and the bonus Umrah) strictly according to the Sunnah of the Prophet Muhammad (PBUH) and to the absolute best of our physical and mental ability. Furthermore, we guarantee to pay for any Dam (penalty) from our own funds should we make a ritual error.
However, we cannot guarantee the spiritual acceptance (Qabul) of the Hajj. The ultimate acceptance of any act of worship rests entirely with Allah (SWT). We perform this sacred trust (Amanah) with pure intentions, but we claim no divine authority over the spiritual outcome.
2. Third-Party Agency and Government Reliance
Due to strict international travel laws, our service relies entirely on third-party entities, specifically:
The Government of Saudi Arabia
The Government of Bangladesh
Approved third-party Hajj Agencies (Kafelas)
We are strictly a proxy performing the physical Hajj. We are not a travel agency, an airline, or a hospitality provider. Therefore, we disclaim all liability for issues caused by these third parties, including but not limited to:
Rejection or delays of Hajj Visas by government authorities.
Sudden changes in Hajj quotas, rules, or pricing by the Saudi or Bangladeshi governments.
Flight cancellations, delays, or luggage loss by airlines.
Substandard food, transportation, or accommodation provided by the Hajj Agency (Kafela) in Mecca, Medina, or during the days of Hajj (Mina, Arafat, Muzdalifah).
3. Financial and Zero-Profit Nature
YourHajjBadal.com is a zero-profit, transparent platform. The funds collected are utilized entirely to cover the actual costs of the third-party agency package, booking fees, and the mandatory Hady (Qurbani). Because we do not retain these funds, we cannot offer refunds once the money has been paid to the respective agencies and governments, as outlined in our Terms and Conditions.
4. Force Majeure and Personal Risk
The journey of Hajj is physically demanding and subject to unpredictable global and regional events. We are not liable for the failure to complete the Hajj Badal service due to events beyond our reasonable control (“Force Majeure”). These include, but are not limited to:
Global or regional health pandemics.
Natural disasters, extreme weather, or political instability in the region.
Severe personal illness, injury, medical emergencies, or the passing of the operator (S M Nahid Hasan) before or during the journey.
(Note: In the unlikely event that the operator cannot travel due to personal illness or visa denial, any funds not yet permanently locked by the agency will be immediately refunded to the sponsor).
