Welcome to YourHajjBadal.com. These Terms and Conditions outline the rules and regulations for the use of our website and the Hajj Badal proxy services provided by S M Nahid Hasan.

By accessing this website and utilizing our services, you accept these terms and conditions in full. Do not continue to use YourHajjBadal.com if you do not agree to all the terms and conditions stated on this page.

1. Description of Service

YourHajjBadal.com provides a personal proxy service for Hajj Badal (performing Hajj on behalf of a deceased, elderly, or severely incapacitated Muslim who is unable to perform it themselves).

  • The service is strictly limited to one slot per year.

  • The service provided will be Hajj Tamattu, involving travel from Bangladesh to Saudi Arabia.

  • The service includes an additional Umrah performed voluntarily by the founder on your behalf, at no extra cost.

2. Zero-Profit Policy & Sincerity of Intent

This is a strictly non-profit spiritual service. The fees collected are strictly to cover the actual costs of the Hajj agency package, government fees, and the mandatory Hady (Qurbani). The operator (S M Nahid Hasan) does not take any financial profit or personal wage from these funds.

3. Booking and Payment Terms

Due to strict Saudi and Bangladeshi government regulations, the operator must travel as part of an approved Hajj agency (Kafela). As such, payments are structured according to agency deadlines:

A. The Booking Fee

A $250 advance booking fee is required 6 to 8 months prior to the month of Dhul Hijjah to secure the single available registration slot.

B. The Package Fee

The remaining balance of the medium-tier package (approximately $5,300) must be paid in full at least 4 months prior to Hajj to clear government and agency requirements.

C. The Hady (Qurbani) Fee

A fee of approximately $190 for the mandatory animal sacrifice must be paid closer to or during the Hajj period.

Accepted Payment Methods: PayPal, Wise, and Direct Bank Transfer (SWIFT). All official agency receipts will be provided for absolute transparency.

4. The “Dam” Guarantee (Penalty)

In Islamic jurisprudence, if a pilgrim misses an obligatory act of Hajj or commits an error, a penalty (Dam) is required.

  • Our Guarantee: Should the operator make any error during the Hajj rituals that requires a Dam, the operator will pay the full cost of the penalty from their own personal funds. The sponsor will not be charged.

5. Cancellations and No Refund Policy

Because this is a zero-profit service and all funds are directly paid to government authorities and third-party travel agencies (Kafela) to secure your booking, flights, and accommodation, we strictly do not offer any refunds once a payment is made.

A. Cancellation by the Sponsor

Once the $250 booking fee or the full package amount is paid, the funds are immediately utilized by the administrative systems and agencies. Therefore, under no circumstances can these funds be refunded if you choose to cancel the service. Please be absolutely certain of your intention and decision before making any payment.

B. Unforeseen External Factors

We cannot provide refunds for cancellations caused by “Force Majeure” (Acts of God), such as global pandemics, sudden border closures, or Saudi government quota reductions. Any highly unlikely retrieval of funds in such extreme cases depends entirely on the respective government and agency policies, over which we have no control.

6. No Printed Certificates

We prioritize Islamic authenticity over commercial practices. We do not issue printed “Certificates of Completion.” Instead, we provide real-time peace of mind via WhatsApp updates, photos, videos (where permitted), and full sharing of agency documentation and flight itineraries. The ultimate acceptance and reward of this Hajj remain with Allah (SWT).

7. Limitation of Liability

While we guarantee to perform the physical rituals of Hajj Badal strictly according to the Sunnah and to the absolute best of our ability, YourHajjBadal.com and Tonay Corp. Ltd cannot be held liable for:

  • Changes in Hajj package pricing imposed by the Bangladeshi or Saudi governments.

  • Delays, flight cancellations, or substandard hotel conditions caused by the third-party Hajj agency (Kafela).

  • Any physical accidents or unforeseen events occurring in Saudi Arabia during the 40-day journey.

8. Governing Law

These terms and conditions are governed by and construed in accordance with the local laws of Bangladesh (where the Hajj registration originates).
